Supreme Court: long pre-trial jail cannot become punishment
The Supreme Court has said that keeping an accused person in jail for a long time before trial cannot be allowed to turn into punishment without trial. A bench of Justices Dipankar Datta and Sheel Nagu made the remark while granting regular bail to former Congress minister Mahesh Chandra Joshi and Mukesh Pathak, accused in a corruption case over Jal Jeevan Mission tenders worth hundreds of crores in Rajasthan, according to Live Law. The Court said serious allegations need scrutiny but cannot alone justify endless pre-trial detention.
Who it affects, and how
- Undertrial prisoners and their families courts must weigh long detention, not just how serious the charges are, when deciding bail
- People accused in financial crime cases they may find it easier to get bail if their trial is delayed
What it means for your work
- Lawyer / legal professional: Useful precedent for bail arguments: delay and long detention weigh against the seriousness of charges.
